Terms of Service

1. Interpretation and Definitions

Affiliate means an entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of more than 50% of the voting securities.

Company (referred to as “the Company”, “we”, “us” or “our”) means 404x.

Country means the Republic of Korea.

Device means any device that can access the Service, such as a computer, cellphone, or tablet.

Service means the Website and related online services provided by the Company.

Website means 404x, accessible at http://404x.com.

You means the individual or legal entity accessing or using the Service, as applicable.

Third-Party Services means services or content provided by third parties that may be displayed, included, or made available through the Service.

These Terms govern your use of the Service and form a binding agreement between you and the Company. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You represent that you are over 18 or the age of majority in your jurisdiction, whichever is higher.

The Service may contain links to third-party websites or services that are not owned or controlled by the Company. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. You access them at your own risk.

4. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, if you breach these Terms or as otherwise permitted by law. Upon termination, your right to use the Service ceases immediately.

5. Limitation of Liability

To the maximum extent permitted by law, the Company and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, business, or goodwill), even if advised of the possibility of such damages.

Our aggregate liability for all claims relating to the Service will be the greater of (a) the amounts you paid to the Company for the Service during the 12 months prior to the event giving rise to the liability, or (b) USD 100.

Nothing in these Terms limits liability for willful misconduct, gross negligence, or other liability that cannot be limited under applicable law.

6. “AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements, be uninterrupted or error-free, or that defects will be corrected.

Without limiting the foregoing, neither the Company nor any of its service providers makes any representation or warranty that: (i) the Service or content will be available, accurate, reliable, or current; (ii) the Service will be uninterrupted or error-free; or (iii) emails sent from the Company are free of viruses, scripts, time bombs, or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties; to that extent, these exclusions may not apply to you.

7. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-law rules.

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Seoul, Republic of Korea. (Alternatively, the parties may agree to arbitration administered by the KCAB.)

8. Export Compliance and Sanctions

You represent and warrant that you are not located in a sanctioned country and are not a prohibited party under applicable export control or sanctions laws (including those of Korea, the United States, and the European Union). You agree to comply with all such laws.

9. Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, it will be interpreted to achieve the intent of the provision to the maximum extent permitted, and the remaining provisions will continue in full force.

A failure to enforce any right is not a waiver of that right.

10. Translation

If we provide a translation of these Terms, the English version controls to the extent of any conflict.

11. Changes to These Terms

We may modify these Terms at any time. Material changes will be notified at least 30 days before they take effect. By continuing to use the Service after the effective date, you agree to the revised Terms.
